Overview

This website, ashburykitchen.com (the "Site"), is operated by Spacelab Marketing LLC, trading as Ashbury Kitchen ("we", "us" or "our"). These terms of service ("Terms") apply to your use of the Site and to any order you place with us. By using the Site or placing an order, you agree to these Terms. Please read them carefully.

Nothing in these Terms affects your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

1. Using the Site

You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. You agree not to use the Site for any unlawful purpose, to interfere with its security or operation, or to upload any harmful code.

We may update, suspend or withdraw any part of the Site at any time without notice. We will not be liable if the Site is unavailable for any period.

2. Products and descriptions

We make every effort to describe and display our products accurately. Colours and finishes may vary slightly from those shown due to screen settings and the handmade nature of some items, including hammered surfaces. Small variations in texture and finish are normal and are not considered a fault.

All products are subject to availability. We may limit quantities or discontinue products at any time.

3. Prices and payment

All prices are shown in pounds sterling (GBP) and include VAT where applicable. Delivery within the UK is free.

We may change our prices at any time, but changes will not affect orders already confirmed. If a product is listed at an obviously incorrect price due to an error, we will contact you before dispatch and you may choose to proceed at the correct price or cancel for a full refund.

We accept Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay and Shop Pay. Payment is taken when you place your order. All payments are processed through a secure, encrypted checkout, and we do not see or store your full card details.

4. Orders and contract

When you place an order, you will receive an email acknowledging it. This does not mean your order has been accepted. A contract between you and us is formed when we dispatch your order and send you a dispatch confirmation.

We may decline or cancel an order, for example if a product is unavailable, there is a pricing error, or we suspect fraud. If we cancel after taking payment, we will refund you in full.

5. Delivery

We deliver to addresses in the United Kingdom only. Orders are usually dispatched within 1 to 2 working days, and orders placed after 1pm are processed from the next working day. Delivery normally takes 6 to 8 working days after dispatch. Delivery times are estimates and may occasionally be affected by events outside our control.

Responsibility for the goods passes to you when they are delivered to the address you provide. Please make sure your delivery details are correct. Full details are in our Shipping policy.

6. Cancellations and returns

You can cancel your order from your order confirmation email within 1 hour of placing it. After that, please contact us and we will do our best to help before dispatch.

Under UK law, you have the right to cancel your order within 14 days of receiving it without giving a reason. We extend this to 30 days. Items must be returned unused, unwashed and in their original packaging. Unless the item is faulty, damaged or incorrect, you are responsible for the cost of return postage.

Refunds are made to your original payment method within 5 working days of us approving your return. Full details are in our Refund policy.

7. Faulty items and your legal rights

Our products must be as described, fit for purpose and of satisfactory quality. If an item is faulty, damaged or not as described, please contact us with your order number and photos. We will arrange a repair, replacement or refund in line with your rights under the Consumer Rights Act 2015, and we will cover the cost of return postage.

Normal wear, such as light surface marks or the natural patina that develops on titanium, is not a fault. Damage caused by misuse, accidents or failure to follow our care instructions is not covered.

8. Product use and safety

Please follow the care and usage instructions supplied with each product. Pans and handles become hot during cooking; always use oven gloves where appropriate. Keep knives out of the reach of children and handle them with care. We are not responsible for injury or damage caused by misuse of our products.

9. Intellectual property

All content on the Site, including text, images, logos, graphics and design, belongs to us or our licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce or use any content for commercial purposes without our written permission.

10. Reviews and user content

If you submit a review, comment or other content, you confirm that it is honest, reflects your genuine experience and does not infringe anyone else's rights. You grant us a non-exclusive, royalty-free licence to use, display and reproduce that content in connection with our business. We may remove any content that we consider inappropriate.

11. Third-party links

The Site may contain links to third-party websites. We have no control over those websites and are not responsible for their content, products or practices.

12. Limitation of liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for any business losses, as our products are for domestic and private use only.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

13. Events outside our control

We will not be liable for any delay or failure to perform our obligations caused by events outside our reasonable control, including strikes, carrier delays, severe weather, pandemics or supply shortages. If such an event affects your order, we will contact you as soon as possible.

14. Privacy

We handle your personal information in line with our Privacy policy and applicable UK data protection law.

15. Changes to these Terms

We may update these Terms from time to time. The version in force when you place your order will apply to that order. Please check this page regularly for any changes.

16. Governing law

These Terms are governed by the laws of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts. This does not affect any mandatory consumer protection laws that apply where you live.
